Filing Requirements:

Design: Kazakhstan


Utility Models:


Duration:
Five (5) years that may be extended for additional three years.

Examination: examination only as to form - after two (2) months from the date of filing application with the Patent Office.

Conventional priority: Twelve (12) months as per Paris Convention.

Annuities: payable annually.

 

 

Utility Models Filing Requirements:

  1. Application in the prescribed form.

  2. Utility model description, including claims, drawings and abstract in Russian or Kazakh (translation from the original language should be provided within two (2) months following the date of application).

  3. Power of Attorney signed by an authorized person and bearing the title of the signatory and the seal. A power of attorney issued by an individual must be notarised. (Power Form)

  4. Confirmation of payment of the relevant official fee.


 

Industrial Designs:


Duration: five (5) years for provisional patent, ten (10) years for a full patent (may be extended for additional five (5) years).

Examination: examination only as to form – after two (2) months from the date of filing application with the Patent Office; substantive examination – within three (3) years from the date of application.

Conventional Priority: Six (6) months as per Paris Convention.

Annuities: payable annually.
 


 

Design Filing Requirements:

  1. Set of 8 photographs (13 x 18 or 9 x 12) of the design, models or  drawings, providing full detail views of its outward appearance; general view of the manufactured article, a presentation of its functional characteristics or an assembly diagram  disclosing the  subject matter of the industrial design; in Russian or Kazakh language (translation from the original language should be provided within two months following the date of application).

  2. Information on the date of first use if any.

  3. Power of Attorney signed by an authorized person and bearing the title of the signatory and the seal. A power of attorney issued by an individual must be notarized.

  4. A certified copy (if necessary) of the first application in any country that is a member to the Paris Convention.

  5. Receipt proving payment of the relevant official fee.
