Oman Updates:

On 27 October 2004, our client, Limabond Ltd, a
Syrian company, filed a trademark application for " Mario Zignoti" -
words in Arabic and Latin and head device - in Class 25 in respect of
the goods ready-made clothes, men's shirts, and women's blouses.
The application was accepted and proceeded to publication; it was
advertised on 1 August 2005 and open for 3 months for opposition
purposes.
Lanificio Ermenegildo Zegna S.P.A.
filed an opposition before the Registrar against the said application
based on confusing similarity with their ERMENGILDO ZEGNA
trademark which was registered in Oman since 1992. They claimed that the
applicant filed his trademark in bad faith to benefit from the
international reputation of ERMENGILDO ZEGNA, Limabond Ltd has
used this Italian name even though its nationality is Syrian, and thus
the registration of Mario Zegnoti will confuse the public
regarding its origin and will lead to unfair competition.
Oman - Patent Requirements
Revised:
Omani Patent
Office (OPO) has revised the PCT national phase requirements at the
beginning of the year 2008, and reduced them to:

A power of attorney duly legalized up to
the Oman Consulate.

International Publication Sheet.
-
International Search Report.
-
Specifications, claims, abstract and
drawings in English with an Arabic translation thereof.

5. PCT Preliminary Examination Report.
Notes:

Arabic translation of the
specifications, claims, drawing and Abstract can be filed within 3
months form the date of application.

Application must be filed within 30
months from original filing date.
-
Documents required in 2, 3 and 5 must be
submitted at the time of filing.

Power of attorney and Arabic translation
can be submitted within 3 months from the date of filing.
