Syria- Beginning of Protection Period 

The Director of the Intellectual Department issued a new regulation in May 2004, in respect of the beginning of the protection period for Trademarks, Patents and Industrial Designs.

 The validity starts for trademarks and industrial designs from the date of payment of publication fees i.e. after approval, and for patents from the filing date.


 

Qatar amendment of trademark filing Requirements 

The Registrar of the Qatari Trademark Office (QTMO) issued, as of June 28, new regulations amending the filing requirements as below :

  1. Legalized power of attorney is required, earlier a simply signed power was accepted.
  2. Certified copy of Extract from the Commercial Registrar of Incorporation or any equivalent document, earlier a legalization was required.
  3. All documents must accompany the application when filed, while earlier, belated documents were accepted.
  4. In case of priority application documents, these can be filed within 3 months after the date of application.

It is worth mentioning that Qatar is taking new measures to speed up the registration procedure.  It now takes 24 months from filing to registration, while it used to take up to five years.


 

Bahrain New Patent Law 

The directorate of Industrial Property in Bahrain has ceased to accept the filing of patent applications with effect from 12 May 2004 due to the non-issuance of the Implementing Regulations of the Patent Law No. 1 of 2004. the Implementing Regulation of the said law is issued.  Further details and developments will follow shortly.


Iran Updates New Department to Fight against Infringers

In an attempt to fight against counterfeit pharmaceuticals and medical products, Iran has set up recently a specialized Office belonging to the General Prosecutor.

The aims of establishing this office are:

1.      To handle efficiently the prosecution of criminal cases relating to trademark Infringements.

2.      Speed up the procedures.

3.      Reduce the requirements from the plaintiff.

4.      To handle the matter by specialized and trained staff. 

Now, it is possible to directly file a complaint with this office, instead of the court, and take immediate effective action.

Iraq new regulations Regarding Registration of Trademark in class 34 

  As of July 2004, the Iraqi Trademark Office issued a new regulation regarding the registration of trademarks in Class 34.

1.      It is no longer required to provide a sample of the packs of the trademark to be registered.

 

2.      The requested Certificate attesting that the applicant is licensed to manufacture and / or trade the products of the class 34 is not needed anymore. 

It is worth mentioning that the officials are studying the possibilities of changing the duration of protection from 15 to 10 years.
