Filing Requirements:

Patent: Bangladesh


Patent Assignment requirements:
  1. Power of attorney by both parties. simply signed.

  2. Deed of assignment legalized up to the consulate.

  3. A consideration of $1 is acceptable.

 

Member of International Agreements:
  1. Convention establishing the World Intellectual Property Organization (accession/acceptance, etc., By Bangladesh on May 11, 1985).

Notes :

Time necessary to obtain registration of patent is 18-24 months.

 

Patent Types:
  1. Patent for single invention.

  2. Single patent for cognate invention.

  3. Patents of addition.

  4. Reciprocity application.

 

Novelty requirements:
A Patent may be granted for a new invention. Invention means any new and useful:-
  1. Art, process, method or manner of manufacture.
  2. Machines, apparatus or other article.
  3. Substance produced by manufacture, and includes any new or useful improvement of any of them and an alleged invention.

 

 

General:
Claiming Priority: A priority may be claimed in respect of a patent registered in any country under The Paris Convention Union within one year of the registration.
Bangladesh not yet adopted PCT so PCT National Phase will not get priority. But there is a strong possibility of acceptance of PCT within one year which means by June 2006.

Examination: After having all the documents a Patent Application may be filed and the patent number will be instantly provided. In due course it will be examined and objections may be raised by the Patent Office if any. On meeting the objections, if within 4 months there is no opposition then the patent may be registered after payment of sealing fees and the Patent application details would be published in the Gazette.

Protection Period: Protection period for a patent in Bangladesh is 16 years. After 4 years of the grant of the patent it may be renewed for each year up to 16th year.

Publication: After finishing the sealing formalities the patent number and the invention title will be published in The National Gazette.

Annuity: Annuity fees may be paid yearly. It also may be paid for several years in advance. Annuity fees may be paid within 3 months from the date of expiration of the year/s for which annuity fees are paid.

Compulsory licensing: If the applicant interested, an application can be made to the patent office for a compulsory licenses and thus a license may obtained.

Working or Normal working of patents/inventions: Once the patent has been granted it will be protected as per the claims made by applicant/s till its full term (16 years). Within four years of publishing in The National Gadget one can file an opposition for the patent.
