Filing Requirements:

Patent: Brunei


  Patent Requirements:

At present Brunei does not have a national patent system. However, patent protection is possible through re-registration of UK, Malaysian and Singapore patents. Any person/entity who has obtained the sole and exclusive privileges in an invention from the patentee may also apply to re-register the grant in Brunei. Applications for re-registration have to be filed within three years of their grant in one of the above countries. Upon re-registration, the foreign patent will enjoy the same privileges in Brunei as it merits in the country in which it was granted .


  Patent Requirements:
  1. A copy of the granted patent specifications including the drawings duly certified by the relevant Patent Office.

  2. Authorization Form (Form A) signed by the patentee. The name and designation of the signatory have to be inserted in the form, which needs only to be simply signed (no notarization or legalization is required)..

  3. Application Form (Form B), which can be signed by the agent on the applicant's behalf.

  4. The Extract Sheet obtained by the relevant patent office (e.g. in UK, the Register Extract Sheet).
