Filing Requirements:

Patents: Malaysia


  National Patent Requirements:
  1. Description of the invention, claims and abstract . No drawings are allowed in he description although chemical structural formulas and reaction paths are allowed. (Power Form)

  2. Formal drawings.

  3. Full details of the applicant inventor(s).

  4. Certified copy of the priority document in case priority is to be claimed.

  5. Statement Justifying Applicants Right. A brief statement on how the applicant is entitled to the invention is required if the applicant is not the inventor, e.g. by way of assignment, agreement, commission, etc

  6. A Power of attorney duly signed by the applicant. The name and title of the signatory must be indicated beneath the signature

Note:

Patent protection is 20 years from the filing date.

 

  PCT Application:

As of August 16, 2006, the Patent Cooperation Treaty (PCT) entered into force in Malaysia within 30 months from the filing date or the priority date of the international application, whichever is earlier.

 

 

  Filing Requirements:
  1. Power of attorney simply signed, name title of the signatory must be indicated. (Power Form)

  2. International Application Form.

  3. International Search Report.

  4. PCT Demand.

  5. PCT Preliminary Examination Report.

  6. Certified copy of priority document (must be filed within 3 months non extendable).

Note:

Patent protection is 20 years from the filing date.
