Patents: Morocco

  Patent Requirements:

1. A Power of attorney simply signed (Power Form).

2. Three copies of the specifications, claims and drawings in French and Arabic.

3. A Certified copy of the priority document if priority is to be claimed.

Notes :

• Patent is valid for 20 years and annuities are to be paid every year before grant with a grace period of 6 months.

• As of 18 December 2004 the new law No17-97will become effective, accordingly :

1. One patent application will cover both jurisdictions Casablanca and Tangier.

2. Integrated circuits are protected for 10 years as of the filing date.

3. Protection of the inventions of employees.

4. Pharmaceutical compositions, pharmaceutical products and remedies.

5. Documents are to be filed within 3 months.

6. Patents may be subject to seizure in pawn.

7. Licening is compulsory, if not used or worked within a period of three years as of grant, or four years as of filing.

8. Patents relateing to security or public health may be subject to "automatic" licensing.
    

 PCT Requirements:

1. A Deed of assignment duly executed by the inventor(s).

2. International Application Form.

3. International Search Report.

4. PCT Demand.

5. PCT Preliminary Examination Report.

6. A Certified copy of the priority document.

7. Specifications, claims, abstract and drawings in Arabic and French.

8. A Power of attorney simply signed by the applicant. (Power form).

9. International Publication Sheet.

 Assignment Requirements:

1. A Power of attorney simply signed by the assignee (Power Form).

2. A Deed of assignment executed by both parties (Assignment form)..

  License Requirements:

1. A power of attorney simply signed  by the licensee (Power Form).

2. License agreement executed by both parties.

  Change of name /Address Requirements:

1. A Power of attorney simply signed (Power Form) .

2. A Certified copy of the change of name and/or address issued by the competent authority.
