ARIPO

The agreement was singed in Zambia in 1976. The current member states of ARIPO are Botswana, Gambia, Ghana, Kenya, Lesotho, Malawi, Sierra Leone, Somalia, Sudan, Swaziland, Tanzania, Uganda, Zambia, and Zimbabwe. However, only Swaziland, Malawi and Zimbabwe have ratified the Protocol.

 

At the current time, it is possible to designate six ARIPO states in a trademark application, namely: Lesotho, Malawi, Swaziland, Tanzania (Tanganyika), Uganda, and Zimbabwe.

 

Searches would need to be conducted at the National Registers of each of the above countries should protection be required in all relevant countries. 

 

  Trademark Requirements:
  1. Simply singed power of attorney (Form M2), (Power Form).

  2. Details of the applicant.

  3. The list of good and classes pertaining thereto.

  4. Prints of the trademark.

  5. Details of the mark.

 

  Renewal Requirements:

 

Change of Name/ Address Requirements:

  1. Simply signed power of attorney under new name (Power Form).

  2. Official document certifying change of name.

 

  Assignment Requirements:
  • Simply signed power of attorney (Power Form).

  • Deed of assignment signed before two witnesses.

  • Nominal consideration, no Tax implication, no stamp duty.

  • With or without Goodwill, pending applications may be assigned, unregistered marks may be assigned provided it is used in the same business and to the same person.

 

Filing requirements:

  • Power of attorney simply signed (Power Form).

  • 10 prints of the mark.

  •  The time taken to obtain an ARIPO trademark registration will depend largely on the length of time taken by the national registries of the designated states to examine and approve the application for registration. It will take at least 3-4 years to obtain a registration

 

  License registered user:
  1. Simply signed power of attorney from the proprietor and the licensee (Power Form).

  2. Declaration and statement of case, with verified English translation, license agreement with verified English translation.

Classification Of Goods / Services: International Classification.

 

Claiming Priority Under Paris Convention: Yes.

 

Registration Takes: 12 -18 months to complete.

 

Registration Duration: 10 Years from the date of Application.

 

Time Until Issuance Of Registration: 12 Months.

 

Opposition Period:  2 months.

 

Renewal Application: Within 12 months before expiry.

 

Non-Use: A registered marks may be cancelled if it has not been continuously used for 5 years preceding the date 1 month before the date of the request for cancellation.
