Filing Requirements:

Trademarks: Azerbaijan


  Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Details of the applicant.

  3. Thirty prints of the trademark (5x5 cm).

  4. List of goods and or service in accordance with the international classification.

  5. Explanation or the meaning and origin of the mark.

  6. A priority document, if priority is to be claimed.

 

  Renewal Requirements:
  1. Simply signed power of attorney (Power Form).

  2. The application must be signed by the Applicant.

  3. Documentation certifying payment fees.

 

  Change of Name/ Address Requirements:
  1. Official document certifying change of name.

  2. Letter from application informing Patent Office of changes.

 

  Assignment Requirements:
  1. Power of attorney signed by the Assignee (Power Form).

  2. Deed of Assignment document signed by both parties.

  3. No regulations for consideration, no Tax implication, no stamp duty.

  4. Pending Applications and unregistered marks may not be assigned.

 

  Searches:
  1. Method of search: conducted by computer of the official database.

  2. Time to be taken: 2 days, 5 days, 10 days.

  3. Contents: search report including information of prior marks hit by the search and comments on similarity between the subject mark and each relevant prior mark.

  4. Other: Necessity of use search on prior marks should be judged by case.

 

General Information:

Claiming priority under Paris Convention: Yes.

 

Filing International Registration under Madrid Agreement: Yes.

 

Filing International Registration under Protocol to Madrid Agreement: No.

 

Registerable: Trademarks, service marks, collective marks.

 

Registration Duration: 10 years from the date of application.

 

Classification of Goods/ Services: International Classification, multi-class filing.

 

Time until Issuance of Registration: 12 Months.

 

Opposition period: 3 months.

 

Renewal application: Within 12 months before expiry.

 

Use: When a registered mark has not been continuously used for the goods or services concerned for 5 years from the date of registration (or the date of the last use), a cancellation action may be filed by an interested person.
