Filing Requirements:

Trademarks: Bahrain


  Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney stamped with the company seal (Power Form).

  2. Certified copy of the home/ foreign registration certificate. If not available, then a certificate of incorporation or extract from the commercial register or certificate issued by the Chamber of Commerce of the applicant provided the business activity to be mention in the certificate and includes the goods applied for.

  3. Details of the applicant.

  4. List of goods to be covered by the application not more than 6 lines.

  5. Eight prints of the mark.

 

  Renewal of Trademark/ Service Mark Registrations:
  1. Simply signed power of attorney stamped with the company seal (Power Form).

  2. Renewal for the first time should be accompanied by photo copy of registration certificate

 

  Change of Name/ Address Requirements:
  1. A simply signed power of attorney in the new name or address and stamped with the company seal (Power Form).

  2. A letter from the proprietors addressed to the Registrar of Trademark in Bahrain stating their request to effect the change of name or address.

 

  Assignment Requirements:
  1. Simply signed power of attorney by the assignee stamped with the company seal (Power Form).

  2. Duly legalized deed of assignment signed by the assignor and the assignee.

 

  Registered User Requirements:
  1. Simply signed power of attorney by the registered user and stamped with the company seal (Power Form).

  2. A simply signed power of attorney by the original owners of the trademark, and stamped with the company seal (Power Form).

  3. A license agreement or a registered user agreement duly legalized.

 

  Amendment  Requirements:
  1. Letter from the proprietors addressed to the Registrar of Trademark in Bahrain stating their request to effect the amendment.

  2. Seven prints of the amended trademark/ service mark.

 

  Agency Agreements:
  1. Power of attorney legalized up to the Bahraini Consulate (Power Form).

  2. An Agency Agreement executed by the Principal and the Agent legalized up to Bahraini Consulate.

 

General Information:

Classification: International; single-class filing.

The Trademark Office has issued new directives under reference number 6-2/05 accordingly; the 8th edition of the Nice Classification is applied as of July 1, 2005 as outlined below:

  1. New trademark applications in classes 42 to 45 will be accepted.

  2. Trademark applications previously filed in class 42 and not yet published can be amended at the present time.

  3. Trademark applications filed in class 42 and published or the publications fees thereof were paid can not be amended until they are finally registered.

  4. It will not be allowed to renew any trademark registration in class 42 unless it is          amended as pointed out above.

  5. As of July 1, 2005 it will not possible to file any trademark application in Bahrain for:   All goods or services".

  6. Published and registered trademarks will be converted to the new classification as follows:

  1. If the services covered fall in one class other than class 42 an amendment application can be filed to alter the class number to the new class with keeping the same particulars of the respiration.

  2. If the services covered are " all services in class 42", the owner should specify the exact list of services, an if the specified services fall in one class other than class 42 an amendment application can be filed to alter the class number to the new class upon payment of the prescribed fees.

  3. In case the services covered fall in class 42 and other classes, an amendment application should be filed to delete the services falling in the other classes and keep the registration for the services in class 42.  If requested, new applications should be filed for the services in the other classes.

 

Bahrain became a member of Madrid protocol as of August 2005.

 

Claiming priority under Paris Convention: Yes.

 

Time from filing to registration: 24 months.

 

Registration duration: 10 years from filing date.

 

Renewal duration: 10 years.

 

Publication: After application, in the Official Gazette.

 

Opposition period: 2 months.

 

Renewal application: Within 6 months before expiry.

 

Grace period for renewal: 3 months after renewal.

 

Marking  requirements: There are no specific articles in the law regulates the use of the symbols "TM" and "®" on the goods or services. It can  be used on the products whether it is filed or not, whereas the symbol "®" is used to indicate that such  name is  registered as trademark.

 

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation; a court decision must be issued to make cancellation effective.
