Filing Requirements:

Trademarks: Belize


  Trademark/ Service Mark Requirements:
  1. Power of attorney notarized and legalized up to the Belize Consulate or by Apostille (Power Form).

  2. Certified copy of UK registration (if based on a UK registration).

  3. List of goods/services.

  4. Details of the applicant.

  5. Certified copy of the priority document in case convention priority is to claimed.

 

  Renewal Requirements:
  1. Power of attorney must be notarized and legalized up to the Consulate or Apostille (Power Form).

  2. Certified copy of UK renewal certificate.

 

  Change of Name/ Address Requirements:
  • No documents are needed.

 

  Assignment Requirements:
  1. Power of attorney signed by assignee and notarized (Power Form).

  2. Deed of assignment signed by both parties.

  3. Consideration is not acceptable, no tax implication, no stamp duty, with or without Goodwill.

  4. No provision for pending application, unregistered marks may be assigned.

 

General Information:

The New Law:

  • Belize has thus established an independent trademark registration system effect from June 12, 2001. Current UK-based registrations will continue in force in Belize for their remaining term and pending  UK-based applications will be processed as under the prior law, although they will be deemed registered under the new act. Indeed, any applicant for a pending UK registration filed in the UK by January 5, 2001 may apply no later than January 4, 2002 to register the same mark in Belize and thereby preserve the same application or priority date for Belize as accorded in the UK.

  • At the same time, the common law of  “passing off” and the doctrine of “honest concurrent user” have been retained.

 

Classification of Goods/ Services: International or former U.K. Classification, multi- class filing, nice classification.

 

Claiming priority under Paris Convention: Yes.

 

Filing international registration under Madrid Agreement: No.

 

Filing international registration under Protocol to Madrid Agreement: No.

 

Registerable: Trademarks, service marks.

 

Registration duration: 10 years from the date of application.

 

Renewal duration: 10 years.

 

Time until issuance of registration certificate: 6 months.

 

Opposition period: 60 days.

 

Renewal Application: No renewal application.

 

Use: When a registered mark has not been used for 5 years after the mark is entered on Registered, the registration becomes vulnerable to a cancellation action.
