Filing Requirements:

Trademarks: Botswana


  Trademark Filing Requirements:

  1. Simply signed power of attorney (Power Form).

  2. Details of the applicant.

  3. Details of the mark and list of goods/services.

 

  Renewal Requirements:

  • No documents are needed.

 

  Change of Name/ Address Requirements:

  1. Simply signed power of attorney (Power Form).

  2. Certificate of change of name and address, with verified English translation.

 

  Assignment:

  1. Power of attorney signed by the assignee (Power Form).

  2. Assignment document under hand, or Deed of Assignment under seal, signed by both parties.

  3. Nominal consideration is acceptable, no tax implications, no stamp duty, with or without Goodwill.

  4. Pending applications and unregistered marks may be assigned.

 

  Licenses / Registered Users:

  1. Simply signed power of attorney from proprietor and licensee (Power Form).

  2. License agreement, with verified English translation.

 

  Searches:

  1. Method of search: conducted manually.

  2. Time to be taken: 10 days.

 

General Information:

Classification: International classification, single-class filing.

 

Claiming priority under Paris Convention: Yes.

 

Filing international registration under Madrid Agreement: No.

 

Filing international registration under Protocol to Madrid Agreement: No.

 

Registrable: Trademarks, service marks, collective marks.

 

Registration duration: 10 years from filing date.

 

Renewal duration: 10 years.

 

Time until issuance of registration certificate: 36 months.

 

Publication: After accepted in the Journal.

 

Opposition period:  3 months.

 

Renewal application: Within 6 months before expiry.

 

Use: Non-use for 3 years makes the registration vulnerable to cancellation; it is possible to file an intent-to-use application in Botswana.
