Filing Requirements:

Trademarks: Bulgaria


  Trademark Filing Requirements:
  1. Power of attorney simply signed.

  2. Mark and list of goods/services.

  3. Five prints of the mark (7 x 7 cm)

  4. Details of the applicant.

  5. Certified copy of priority document if priority is to be claimed.

 

  Renewal requirements:
  • Simply signed power of attorney.

 

  Change of Name/Address  Requirements:
  1. Official document certifying change of name.

  2. Simply signed power of attorney under new name.

 

  Assignment requirements:  
  1. Assignment document, signed by both parties under hand or seal, notarized and legalized.

  2. Power of attorney signed by assignee.

  3. Nominal consideration is acceptable, no tax implications, no stamp duty, with or without Goodwill

  4. Pending applications may not be assigned, unregistered marks may be assigned.

 

  Searches:
  1. Method of search: Conducted manually and or by computer at the Patent Office.

  2. Time to be taken: 7 working days.

  3. Contents: Search report includes information of prior marks hit by the search and comments on similarity between the subject mark and each relevant prior mark.

  4. Other: A search on actual use of prior mark is not possible.

Filing International Registration under Protocol to Madrid Agreement: Yes.

Registration duration: 10 Years from the date of Application

 

Opposition system: No opposition system.

 

Renewal application: Within 12 months before expiry.

 

Renewal duration: 10 years.

 

Use: When a registered mark has not been continuously used for the goods or services concerned for 5 years, a cancellation action may be filed by an intersed person.
