Filing Requirements:

Trademarks: Colombia


  Trademark Filing Requirements:
  1. Power of attorney notarized and legalized up to the Colombian Consulate (Power Form).

  2. Certified copy of the certificate of incorporation or any equivalent document, notarized and legalized up to the Colombian Consulate.

  3. Certified copy of the priority document duly notarized and legalized up to the Colombian Consulate.

  4. 20 prints of the mark.

  5. Details of the applicant.

  6. Details of the mark.

 

  Renewal Registrations:
  1. Power of Attorney legalized by Apostille or Consulate (Power Form).

  2. Certificate of Good Standing of the company, and then have it legalized.

 

  Change of Name/ Address Registrations:
  1. Power of attorney notarized and legalized up to the Colombian Consulate (Power Form).

  2. Extract from the commercial register evidencing the change of name duly legalized up to the Colombian Consulate.

  3. List of trademarks concerned.

 

  Assignment Requirements:
  1. Power of Attorney legalized by Apostille or Consulate (Power Form).

  2. Assignment Deed duly legalized by Apostille or Colombian Consulate.

  3. Certificate of Good Standing of the company, and then have it legalized.

 

  Searches:

  1. Method of search: Conducted by computer on the official database.

  2. Time to be taken: 5-8 days.

  3. Contents: Search report includes information of prior marks hit by the search and comments on similarity between the subject mark and each relevant prior mark.

  4. Other: Necessity of use search on prior mark should be judged case by case.

 

General Information:

Classification of Goods / Services: International Classification.

 

Claiming priority under Paris Convention: Yes.

 

Filing International Registration under Madrid Agreement: No.

 

Filing International Registration under Protocol to Madrid Agreement: No.

 

Time until Issuance of Registration Certificate: 12 Months.

 

Registration Duration: 10 Years from the date of Application.

 

Renewal duration: 10 years.

 

Renewal Application: Within 6 months before expiry.

 

Opposition period: 30 days.

 

Use: When a registered mark has not been continuously used in at least one of the Andean Community member countries (Bolivia, Colombia, Ecuador,Peru and Venezuela)for the good or services concerned for 3 years preceding the request for cancellation, a cancellation action may be filed by an interested person .
