Filing Requirements:

Trademarks: Costa Rica


  Trademark Filing Requirements:
  1. Power of attorney legalized up to the Costa Rican Consulate (Power Form).

  2. Details of the Applicant.

  3. Details of the mark.

  4. Classes and list of goods.

  5. Home registration certificate legalized up to the Consulate, in case not registered yet, then a Statement of Adopted Trademark must be executed and legalized. 

 

  Renewal Registrations:
  • Power of attorney legalized up to the Costa Rican Consulate (Power Form).

 

  Change of Name/ Address Registrations:
  1. Power of attorney legalized up to the Costa Rican Consulate (Power Form).

  2. Certificate of change of name duly legalized up to the Costa Rican Consulate.

  3. List of trademarks concerned.

 

  Assignment Requirements:
  1. Assignment document, legalized by Costa Rican Consul.

  2. Power of attorney signed by the Assignee, legalized by the Costa Rican Consul (Power Form).

  3. Nominal consideration is acceptable, no tax implication, no stamp duty, with or without Goodwill.

  4. Pending Applications and unregistered marks may be assigned.

 

  Searches:

  1. Method of search: Conducted by computer on the official data base.

  2. Time to be taken: 1-2 days.

  3. Contents: Search includes information of prior marks hit by the search and comments of registrability.

  4. Other: A search on actual use of prior mark is not necessary.

 

General Information:

Classification of Goods / Services: International Classification.

 

Claiming priority under Paris Convention: Yes.

 

Filing International Registration under Madrid Agreement: No.

 

Filing International Registration under Protocol to Madrid Agreement: No.

 

Time until issuance of Registration Certificate: 12 months.

 

Registrable: Trademarks, Service marks, collective marks.

 

Registration Duration: 10 Years from the date of Application.

 

Renewal Application: Within 12 months before expiry.

 

Renewal duration: 10 years.

 

Opposition period: 2 months.

 

Use: A registered mark may be cancelled if it has not been used for 5 years following the date of registration.
