Filing Requirements:

Trademarks: Madagascar


Trademark Filing Requirements:

  1. Full name, street address and description of the applicant (including
    trading style, if any, and state country of incorporation).

  2. List of goods.

  3. A French power of attorney, notarized. (Power From)

  4. Specimen of the device mark.

  5. Priority document if claimed.

 

  Renewal Requirements:
  1. Power of Attorney notarized. (Power From)

  2. Ten prints of the mark.

 

Assignments/Mergers Requirements:

  1. Power of Attorney notarized. (Power From)

  2. Deed of Assignment or other instrument of title signed by both
    parties.

 

Change of Name Requirements:

  1. Power of Attorney notarized. (Power From)

  2. Certificate of Change of Name, with verified French translation.

 

Change of Address Requirements:

  1. Power of Attorney notarized. (Power From)

 

Licenses/Registered Users requirements:

  1. Powers of Attorney signed by both parties notarized. (Power From)

  2. License Agreement, notarized.

 

  Assignment Requirements:
  1. Deed of assignment legalized.

  2. Power of Attorney. (Power From)

  3. Nominal consideration is acceptable, recordation fee , no stamp duty, with or without Goodwill.

  4. Pending application and unregistered mark may not be assigned.

Use: Non-use for 3 years from the effective date makes the registration vulnerable to cancellation; it is possible to file an intent-to-use application in Madagascar
