Filing Requirements:

Trademarks: Malawi


  Trademark/Service Mark Requirements:
  1. Simply singed power of attorney. (Power Form)

  2. Twelve prints of the trademark (not required for word marks).

  3. Statement of whether the trademark is used or proposed to be used in Malawi.

 

  Renewal Requirement:

 

  Change of Name/ address:

  1. Simply signed power of attorney. (Power Form)

  2. Official document certifying change of name.

 

  Assignment Requirement:
  1. Deed of assignment, signed by both parties.

  2. Power of attorney simply signed by assignee. (Power Form)

Notes:

  1. Some consideration must be stated; nominal consideration is acceptable.

  2. No tax implications.

  3. No stamp duty.

  4. Assignments may be made with or without Goodwill.

  5. Pending applications may not be assigned.

  6. Unregistered marks may be assigned, but only if it is used in the same business as a registered mark and to the same person as the registered mark.

 

General Information:

Classification: International; single-class filing.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, certification marks.

 

Time from filing to registration: 2 months.

 

Registration Duration: 7 years from filing date.

 

Renewal Duration: 14 years.

 

Renewal Application: Within 6 months before expiry.

 

Publication: After acceptance, in the Patent and Trade Marks Journal.

 

Opposition Period: 2 months.

 

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation; it is possible to file an intent-to-use application in the Malawi.
