Filing Requirements:

Trademarks: Mauritius


  Trademark/Service Mark Requirements:
  1. Power of attorney legalized up to a Consul for Mauritius, if no such Consul is available, then up to a British Consular or attested by an Apostille. (Power Form).

  2. Class 1-34 only applied at current time. There is no classification system, and applicants should describe the goods of interest as the new law is still not operational.

  3. Five prints of the mark.

 

  Renewal requirement:
  • No document is required, but the Registrar may ask for a power of attorney. (Power Form)

 

  Change Of Name/Address Requirements:
  1. Power of attorney legalized up to the British Consulate (Power Form).

  2. Certificate of change of name notarized up to the British Consulate.

  3. List of trademarks concerned.

 

  Assignment Requirements:
  1. Deed of document signed by both parties, notarized and certified by Apostille.

  2. Power of attorney from assignee notarized and certified by Apostille. (Power Form)

  3. Some consideration must be stated; nominal consideration is acceptable.

  4. For goods, ad valorem tax of 8.8 percent is payable; for services, ad valorem tax of 4.4 percent is payable.

  5. No stamp duty.

  6. Assignments may be made with or without Goodwill.

  7. Pending applications may be assigned.

  8. Unregistered marks may not be assigned.

Claiming priority under Paris Convention: No.

 

Registration Duration: 7 Years from the date of Application.

 

Time until Issuance of Registration: 60 Months.

 

Renewal Application: Within 3 months before expiry.

 

Renewal Duration: 14 years.
