Filing Requirements:

Trademarks: Morocco

  Trademark/Service Mark Requirements:
  1. Power of attorney simply signed and must be stamped and sealed by the applicant; the name and capacity of the signatory should be indicated clearly on the power. An advanced copy by fax or e-mail will be accepted. (Power Form)

  2. Printing block (not exceeding 8 x  8 cm). 

  3. Certified copy of the basic registration only for claiming convention priority.

 Notes:

 As of 18 December 2004 the new IP law became in force, accordingly:

  1.  One application will cover the 2 Zones Casablanca and Tangier.

  2.  Duration became 10 years instead of 20.

  3.  Grace period of 6 months is given for renewals.

  4.  Non use of the mark for 5 years will result in the cancellation of it.

 

  Renewal Of Trademark Registration:
  1. Simply signed power of attorney. (Power Form)

  2. A printing block and prints of the mark.

 

  Change Of Name/Address Requirements:
  1.  Simply signed power of attorney by the licensee. (Power Form)

  2.  Certified copy of the change of name and /or address.

 

  Assignment Requirements:

License/ registered user recordal

  1. Simply signed and sealed power of attorney by the assignee. (Power Form)

  2. License/ registered user agreement executed by both parties.

  3. The Duration of agreement must be indicated and should not exceed the validity date of the mark subject of the license or registered user.

Registration is made as per article 156 of the IP Law No17 for the year 1997.

 

Registration with Custom Duty Department:

It is possible to record and registered trademark in Morocco with the Customs Authorities at any time during the validity period of his trademark in order to suspension of imported counterfeit goods.

Such application can be filed can be submitted by the legal representative or the licensee of the mark.

The request for suspension is valid for one year and can be renewed each year.

Once imported products are suspected to be counterfeited, the customs inform immediately the right holder or his agent who should within 10 days justify to customs that a preliminary injunction has been ordered by the president of the court or that a court action has been initiated against payment of a guarantee. Otherwise, the suspension measure is forfeited and becomes void. Customs are allowed to provide the trademark owner with available information on the importer of counterfeits and the origin.

Once the suspended goods are declared being counterfeit by a final court decision, they would be destroyed. In the contrary, i. e. if said goods were not found to be counterfeit by the court, the importer has the right to claim damages.

 

Requirements:

  1. Certified copy of trademark registration certificate.

  2. Simply signed power of attorney.

Classification of Goods / Services: 8th Edition of Nice Classification classes 1- 45. Multi-class application.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, service marks, collective marks.

 

Time from filing to registration: 2-3 months.

 

Registration Duration: 10 years from the date of Application as of December 2004.

 

Renewal Duration: 10 years as of December 2004.

 

Publication: After registration, in the Official Gazette.

 

Opposition Period: 2 months from date of publication.

 

Renewal Application: Within 6 months before expiry. Grace period  of 6 months is given by the new law.

 

Use: A registered mark may be cancelled if it has not been used for consecutive 5 years.
