Filing Requirements:

Trademarks: Sao Tome & Principe


  Trademark/ Service Mark Requirements:

  1. Details of the applicant.

  2. List of goods.

  3. Fifteen(15) prints of the mark.

Note:

Power of attorney is not required.

 

  Renewal of Trademark/ Service Mark Registrations:
  • No special documents required.

 

  Change of Name Requirements:

  • Certificate of Change of Name (with Portuguese translation).

 

  Change of Address Requirements:

  • No documents required.

 

  Assignment Requirements/ Mergers:

  • Deed of Assignment, Certificate of Merger, with Portuguese translation.

 

  License:

  • License Agreement (with Portuguese translation).

 

  Registration Requirements:

  1. Details of the mark, Visual representation of the mark, Class(es) in which mark is to be registered, and a reasonably precise description of the goods and/or services on which it is used or to be used

  2. Details of the applicant .

  3. Certified copy of the application or registration concerned.

  4. Authorization of Agent simply signed.

  5. Registration typically takes 12-18 months to complete.

 

General Information:

Classification: The International Classification of goods and services applies.

Multi- class application is acceptable to cover any number of goods and/or services.

 

International Agreement: Paris Convention

 

Type of Trade Marks registrable: Trademarks, service marks, and collective marks. No provisions at the law for the registration of defensive or series marks

 

Trademarks: The IP law came into force on March 2005 in respect of trademark registration. But until now, the Trade mark registry is not established.
