Filing Requirements:

Trademarks: Saudi Arabia


  Trademark/ Service Mark Requirements:
  1. Power of attorney legalized up to the Consulate of Saudi Arabia. One general power of attorney can be used for several applications. (Power Form)

  2. Fifteen prints of the trademark. A trademark print should not exceed 7x7 centimeters.

  3. Certified copy of priority document in case claimed

 

  Renewal Registrations:
  1. Power of attorney notarized and legalized up to the Consulate of Saudi Arabia. (Power Form)

  2. The Registration Certificate for  endorsement.

Note:

grace period of 6 months is allowed for late renewal after of payment of penalty.

 

 Change of Name/Address requirements:
  1. Legalized power of attorney showing the new name and / or address.  (Power Form)

  2. Legalized certificate of change of name or address.

  3. Registration Certificate for endorsement.

 

  Assignment / Merger Requirements:
  1. Power of attorney legalized up to the Consulate of Saudi Arabia. (Power Form)

  2. Legalized Deed of assignment executed by both assignor and assignee. (Assignment Form)

  3. The Registration Certificate for endorsement.

 

  License registered users:
  1. Power of attorney duly legalized up to the Saudi Arabia Consulate. (Power Form)

  2. License agreement duly legalized up the Saudi Arabia Consulate.

  3. Registration Certificate for endorsement purposes.

 

General Information:

Classification: 8th Edition of Nice Classification, class 1 - 45.

 

Note: Registration in class 33 is not allowed.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, service marks, collective marks.

 

Time from filing to registration: 12 months.

 

Registration Duration: 10 Hijra years from filing date ( approximately 10 years less 100 days).

 

Renewal Duration: 10 years.0 Hijra years from filing date ( approximately 10 years less 100 days).

 

Publication: After acceptance, in the Official Gazette.

 

Opposition Period: 3 months.

 

Renewal Application: Within 12 months before expiry.

 

Marking Requirements: There are no specific articles in the law regulates the use of the symbols "TM" and "?" on the goods or services. It can be used on the products whether it is filed or not, whereas the symbol "?" is used to indicate that such name is registered as trademark.

 

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation; intent-to-use applications may be field in Saudi Arabia
