Filing Requirements:

Trademarks: Singapore


  Trademark Filing Requirements:
  1. Power of attorney is not required.

  2. Specimen of the mark.

  3. Full particulars of the applicant.

  4. List of goods & international classification.

  5. If the applicant is a sole proprietorship or partnership trading as a firm, please provide the full names of the sole proprietors/partners and a certified extract of the said information from the Registry of Business or equivalent.

 

 Renewal requirements:
  • No document required.

 

  Change of Name/ Address Requirements:
  1. Official document certifying change of name. .

  2. Signed application form

 

  Assignment requirements:
  1. Assignment document signed both parties.

  2. Nominal consideration is acceptable, no tax implications, stamp duty, with or without Goodwill.

  3. Pending applications may be assigned.

  4. Unregistered marks may be assigned with Goodwill.

 

General Information:

Multi-class Applications: Amendments to Singapore's Trade Mark Act (332/05), Singapore Trade Mark laws amended to provide for the following changes effective 2 July 2007:-

  • Multi-class applications while official fees remain same.

  • Division of single and multi-class applications (for a fee), to expedite registration procedure in case the Examiner raises objections, or where there is an opposition, in respect of only some of the classes, so that those classes of goods or services that do not face objection or opposition may proceed to registration first.

 

Claiming priority under Paris Convention: Yes.

 

Member of Madrid Agreement: No.

 

Member of Madrid Protocol: Yes.

 

Member of Nice Agreement: Yes.

 

Registrable: Trademarks, service marks, collective marks, certification marks.

 

Time from filing to registration: 12-36 months.

 

Registration Duration: 10 years from filing date.

 

Renewal Duration: 10 years.

 

Publication: After acceptance of the application, in the Trademarks Journal.

 

Opposition Period: 2 months.

 

Renewal Application: Within 3 months before expiry.

 

Grace period allowed for renewal: 1 Year from due date.

 

Recordal of License Agreement: As per new Act effective 2 July 2007, it became possible.

 

Use requirement: Non-use for 5 years following registration makes the registration vulnerable to cancellation; intent-to-use applications may be field in Singapore.
