  Trademark/Service Mark Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Six prints of the mark.

 

  Renewal Registrations:

 

 Change of Name/Address requirements:
  1. Simply signed power of attorney (under new name). (Power Form)

  2. Official document certifying change of name.

 

  Assignment Requirements:
  1. Assignment document signed by both parties with Goodwill.

  2. Power of attorney signed by assignee. (Power Form)

  3. Nominal consideration is acceptable, no tax implications, no stamp duty, with or without Goodwill.

  4. Pending application may be assigned.

  5. Unregistered marks may be assigned.

 

General Information:

Classification: International; single-class filing.

 

Claiming priority under Paris Convention: yes.

 

Registrable: Trademarks, service marks, collective marks, certification marks.

 

Time from filing to registration: 42 months.

 

Registration Duration: 10 years.

 

Publication: After acceptance, in the Journal.

 

Opposition Period: 3 months.

 

Renewal Application: Within 6 months before expiry, with late renewal period 1 year.

 

Renewal Period: 10 years.

 

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation; it is possible to file an intent-to-use applications in South Africa.

 

Marking: It is possible to use the symbol ® after completing registration to indicate that the mark is registered rights.
