Filing Requirements:

Trademarks: Sri Lanka

Trademark/ Service Mark Requirements:

Simply signed power of attorney (Power Form).
Photocopy of the home/foreign registration certificate.
Eight prints of the mark.
Date at 1st use if any.

Renewal of Trademark/ Service Mark Registrations:

Simply signed power of attorney and stamped with the company seal. (Power Form)

Change of Name/ Address Requirements:

Simply signed power of attorney in the new name of address and stamped with the company seal. (Power Form)
Certified copy attesting the change.

Assignment Requirements:

Simply signed power of attorney by the assignee and stamped with the company with the company seal. (Power Form)
Legalized deed of assignment signed by the assignor and the assignee.

Registered User Requirements:

Simply signed power of attorney by the registered user and stamped with the company seal. (Power Form)
Simply signed power of attorney by the original owners of the trademark, and stamped with the company seal.
License agreement or a registered user agreement legalized.

General Information:

Classification: International; single-class filing.

Claiming priority under Paris Convention: Yes.

Registrable: Trademarks, service marks.

Time from filing to registration: 12 months.

Registration Duration: 10 years from filing date.

Renewal Duration: 10 years.

Publication: After application, in the Official Gazette.

Opposition Period: 3 months.

Renewal Application: Within 6 months before expiry.

Marking Requirements: There are no specific articles in the law regulates the use of the symbols "TM" and "®" on the goods or services. It can be used on the products whether it is filed or not, whereas the symbol "®" is used to indicate that such name is registered as trademark.

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation; a court decision must be issued to make cancellation effective.
