Filing Requirements:

Trademarks: Sudan


  Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Extract from the commercial register or certificate of incorporation legalized up to the Sudanese Consulate.

  3. Sixteen prints of the trademark for each class.

  4. The list of the goods service to be covered by the application, one application should not cover all the goods in one class.

  5. The meaning, if any a word mark.

  6. When the application matures into registration, the Registrar requests a simply signed declaration on the applicants’ letterhead paper stating that the applicant did not change their legal entity, name or address.

Notes:

  • An Authorization of Agent is valid for 5 years.

  • The Registrar sometimes ask for a certified copy of the corresponding home registration of the trademark.

 

  Renewal Requirements:
  1. Simply signed power of attorney. (Power Form)

  2. The trademark registration number and class of goods

  3. The date of expiration of the trademark registration.

 

  Change of Name/ Address Requirements:
  1. Simply signed power of attorney (Power form).

  2. Certificate of change of name/ address legalized up to the Sudanese consulate.

  3. Registration certificate for endorsement.

 

  Assignment Requirements:
  1. Simply signed power of attorney. (Power Form)

  2. Deed of assignment legalized up to the Sudanese consulate. (Assignment Form)

  3. The trademark certificate of registration for endorsement purposes.

  4. Extract from the commercial register or certificate of incorporation of the assignee,  legalized up to the Sudanese Consulate.

 

  Agency Agreements:
  1. Simply signed power of attorney (Power form).

  2. Agency Agreements executed by the Principal, and the Agent, legalized up to the Sudanese Consulate.

  3. Certified copy of the certificate of incorporation of the licensee legalized up to the Sudanese Consulate.

 

  License Applications:
  1. Power of Attorney signed and stamped by the applicant's seal. (Power form).

  2. Certified copy of the license agreement legalized up to the Sudanese Consulate abroad, the date of executing the agreement should not exceed 6 months.

  3. Certified copy of the certificate of incorporation of the licensee legalized up to the Sudanese Consulate.

  4. Legal Form No.4 to be completed (duly legalized and notarized).

Notes:

In case licensee is Sudanese, the following additional documents are needed:

   - An Approval Letter from the Sudanese Ministry of Industries to the licensee.

International Registration of Madrid Agreement: Yes

 

Registrable: Trademarks, service marks, device marks.

 

Time from filing to registration: 24 months.

 

Registration Duration: 10 years from filing date.

 

Renewal Duration: 10 years.

 

Publication: After acceptance, in the Official Gazette.

 

Opposition Period: 8 months.

 

Renewal Application: 3 - 2 months before expiry.

 

Use: Non-use for 5 years following registration makes the registration vulnerable to cancellation.
