  Trademark/ Service Mark Requirements:

  1. Simply signed power of attorney (Power Form).

  2. Ten prints of the mark for device marks.

  3. Certified true copy of the priority document if priority claimed.

 

  Renewal of Trademark/ Service Mark Registrations:

 

  Change of Name/ Address Requirements:

  1. Simply signed power of attorney. (Power Form)

  2. Certificate of change of name.

  3. List of trademarks concerned.

 

  Assignment Requirements:

  1. Assignment document signed by Assignor and Assignee.

  2. Power of attorney signed by the Assignee. (Power Form)

  3. No acceptable consideration, no tax implications, no stamp duty, with or without Goodwill.

  4. Pending applications may not be assigned and unregistered marks may be assigned.

 

General Information:

Classification: International classification, from 1 to 34.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, service marks.

 

Time from filing to registration: 6 months.

 

Registration Duration: 10 years from filing date.

 

Renewal Duration: 10 years.

 

Renewal Application: Before expiry.

 

Publication: After registration, in the Official Gazette.

 

Opposition Period: No opposition system.

 

Use: Non-use for 3 years following last use makes the registration vulnerable to cancellation; use in the Netherlands is sufficient.
