Filing Requirements:

Trademarks: Swaziland


  Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney. (Power Form)

  2. Ten prints of the mark (not required for word marks).

 

  Renewal Registrations:

 

  Change of Name/ Address Requirements:
  • Simply signed power of attorney under new name. (Power Form)

 

  Assignment Requirements:
  1. Deed of assignment signed by both parties.

  2. Simply signed power of attorney signed by the Assignee. (Power Form)

  3. Nominal consideration acceptable, no tax implications, no stamp duty, with or without Goodwill.

  4. Pending applications and unregistered marks may be assigned.

 

General Information:

Classification of Goods / Services: International; multi-class filing.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, series marks.

 

Time from filing to registration: 18 months.

 

Registration Duration: 10 years from filing date.

 

Renewal Application:: Within 6 months before expiry.

 

Renewal Duration: 10 years.

 

Publication: After acceptance, in the relevant Gazette.

 

Opposition Period: 3 months.

 

Use: Non-use for 3 years or any consecutive 5 years period of non-use makes the registration vulnerable to cancellation. Proof of use at any time during the three-year period immediately preceding renewal is required. In the absence of such use, proof of special circumstances which resulted in the non-use must be submitted. It is possible to file an intent-to-use application in Swaziland.
