Filing Requirements:

Trademarks: Tajikistan


  Trademark/Service Mark Applications:
  1. Simply signed power of attorney. (Power Form).

  2. Twenty prints of the trademark (5x5cm).

  3. The explanation or the meaning and origin of the mark.

  4. A priority document, if claimed.

 

  Renewal requirements:

 

  Change of Name / Address requirements:
  1. Simply signed power of attorney under new name. (Power Form)

  2. Official document certifying change of name.

 

  Assignment requirements:
  1. Power of attorney signed by the Assignee. (Power Form)

  2. Deed of assignment , signed by both parties under seal.

  3. Consideration not be stated, no tax implication, no stamp duty, with or without Goodwill.

  4. No provisions for pending applications, unregistered marks may not be assigned.

 

 

General Information:

Claiming priority under Paris Convention: Yes.

 

Registration Duration: 10 Years from the date of Application.

 

Classification of Goods / Services: International Classification.

 

Opposition period: 60 days.

 

Time until Issuance of Registration: 5 Years .

 

Subsequent filing of power of Attorney: 2 months from filing .

 

Subsequent filing of priority document: 3 months from filing .

 

Opposition Against National Application: No Opposition.

 

Use: When a registered mark has not been continuously used for the goods or services concerned for 5 years from the dare of registration (or the date of the last use ),a cancellation action may be filed by an interested person.

 

Use requirement: Any interested party may file a request for cancellation of a trademark registration if the trademark has not been in use for three years from the registration date. The request may relate to all or part of the goods specified in the certificate of registration and will be ruled on by the Board of Appeals.
