Filing Requirements:

Trademarks: Tanganyika (Tanzania)


  Trademark Filing Requirements:
  1. Simply signed power of attorney. (Power Form)

  2. Mark and list of goods.

  3. Full particulars of the applicant.

  4. Specimen of the mark and a printing block (in case the mark is a device).

  5. Special power of attorney form is required.

 

 Renewal Requirements:

Note:

A grace period of one month is granted, though in practice, TMO may allow it until a notice is published by TMO to remove the mark.

 

 Change of Name / Address Requirements:

  • Simply signed power of attorney. (Power Form)

  • Certificate attesting the change of name.

  • Registration certificate for endorsement.

 

  Assignment requirements:
  1. Power of attorney signed by the Assignee. (Power Form)

  2. Deed of assignment under seal signed by both parties.

  3. Nominal consideration is acceptable, no tax implications , no stamp duty, with or without Goodwill.

  4. Pending applications may not be assigned, unregistered marks may be assigned but only effective between the parties.

 

 License Agreement:

  • Simply signed power of attorney by licensor. (Power Form)

  • Certificate attesting the change of name.

 

General Information:

Tanganyika is part of Tanzania, the latter consists of 2 zones Tanganyika and Zanzibar as they have joined to form the Republic of Tanzania, no unified Registry or IP Law has been enacted, in order to obtain comprehensive protection, registration have to be obtained in both jurisdictions.

 

Classification of Goods/ Services: International Classification from 1 to 42.

 

Claiming priority under Paris Convention: Yes. Trademark protection for Tanzania is obtained by filing separate applications at the Tanganyika and Zanzibar trademark registries.

 

Registration Duration: 10 years from the date of Application.

 

Opposition period: 60 days.

 

Time until Issuance of Registration: Certificate 24 Months

 

Use: when a registered mark has not been continuously used for the goods or services concerned for 3 years preceding the date 1 month before the request for cancellation, a cancellation action may be filed by an interested person.
