Filing Requirements:

Trademarks: Thailand


  Trademark/ Service Mark Requirements:
  1. Power of attorney notarized. (Power Form)

  2. Twenty five specimens of the mark.

  3. Certified copy of the priority document if claimed.

 

  Renewal of Trademark/ Service Mark Registrations:

 

  Change of Name/ Address Requirements:
  1. Notarized power of attorney under new name. (Power Form)

  2. Notarized corporate affidavit.

 

  Assignment Requirements:
  1. Assignment document legalized. (Assignment Form)

  2. Nominal consideration is acceptable, no stamp duty, taxes payable; personal income tax, corporate tax, value added tax.

  3. With or without Goodwill, pending applications may be assigned.

  4. Unregistered marks may be assigned provided it is with Goodwill.

 

General Information:

Classification: International classification, while application covers one item of list of goods, additional fees for each additional word are to be paid, under the same class.

 

Claiming priority under Paris Convention: No.

 

Member of Madrid Agreement: No.

 

Member of Madrid Protocol: No.

 

Member of Nice Agreement: No.

 

Registrable: Trademarks, service marks, certification marks, collective marks.

 

Time from filing to registration: 12 months.

 

Registration Duration: 10 years from filing date.

 

Renewal Duration: 10 years.

 

Renewal Application: Within 90 days before expiry.

 

Grace period allowed for renewal: No grace period.

 

Publication: Before registration, in the Trademark Gazette.

 

Opposition Period: 3 months.

 

Use: Non-use for 3 years following registration makes the registration vulnerable to cancellation; it is possible to file for protection of mark that is not being used.
