Filing Requirements:

Trademarks: Turkey


  Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Certified copy of activity certificate issued by the chamber of commerce at the applicant’s domicile and phone No. of the applicant.

  3. Twenty-five prints of the trademark (not required for word mark).

 

  Renewal Requirements:

 

  Change of Name/ Address Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Certificate of change of name duly notarized.

  3. Original trademark registration certificate for endorsement purposes.

 

  Assignment Requirements:
  1. Simply signed power of attorney (Power Form).

  2. Notarized Assignment Agreement. (Assignment Form)

  3. Activity Certificate in the name of assignee issued by chamber of commerce.

  4. Nominal consideration is acceptable, stamp duty payable to the notary public, with or without goodwill.

  5. Pending applications may be assigned, unregistered marks may not be registered.

  6. Tax payable only if either party has Turkish nationality.

 

General Information:

Classification: International classification, multi- class is possible.

 

Claiming priority under Paris Convention: Yes.

 

Registrable: Trademarks, service marks, collective marks, guarantee marks.

 

Time from filing to registration: 14_18 months.

 

Registration Duration: 10 years from registration date.

 

Renewal Duration: 10 years.

 

Renewal Application: The renewal application can be filed within 6 months before expiry.

 

Publication: Official Industrial Property Journal.

 

Opposition Period: 3 months.

 

Use: Non-use for 5 years following the date of registration or for any other uninterrupted 5 year period leaves the mark vulnerable to cancellation.
