Filing Requirements:

Trademarks: Zaire (Congo)

Democratic Republic of Congo (Formerly Zaire)

 
 Trademark/ Service Mark Requirements:
  1. Simply signed power of attorney must be submitted in duplicate (Power Form).

  2. Mark and list of goods.

  3. Full particulars of the applicant and type of legal entity.

  4. Ten (10) prints of the mark and a printing block (in case the mark is a device).

  5. Certified copy of priority document is claimed.

Notes:

  • Congo adopts the multi-class filing system

  • It is not possible to file service marks.

  • The International Classification of goods in adopted.

 

  Renewal of Trademark/ Service Mark Registrations:
  1. Power of attorney in duplicate simply signed. (Power Form)

  2. Original certificate of registration for endorsement.

 

  Change of Name/ Address Requirements:
  1. Simply signed power of attorney in duplicate. (Power Form)

  2. Certificate of change of name duly notarized.

  3. Original registration certificate for endorsement purposes.

 

  Assignments / Mergers Requirements:
  1. Power of attorney in duplicate simply signed. (Power Form)

  2. Original Certificate of Registration for endorsement.

  3. In the case of an assignment ‘Acte de Cession de Marque’ in duplicate, legalized up to a Congo (Zaire) Consul.

  4. In the case of a merger Certificate, of Merger, with verified French translation and Demande de Transmission de Marque, in duplicate (legalized).

 

  Licenses / Registered Users Requirements:

  1. Power of attorney in duplicate simply signed. (Power Form)

  2. License Agreement, with verified French translation.

 

General Information:

Claiming priority under Paris Convention: Yes.

 

Registration Duration: 10 Years from the date of Application.

 

Classification of Goods / Services: International Classification of goods only as service marks are not registered.

 

Time until Issuance of Registration: 24 Months.

 

Opposition Period: No opposition system.

 

Renewal Application: The renewal Application can be filed within 12 months before expiry with grave period of 6 moths after payment of penalty.

 

Use: When a registered mark has not been used for any period of 3 consecutive following registration, a cancellation action may be filed.
